Court of Cassation in France
The Court of Cassation in France is the Supreme Court of the state whose decisions cannot be challenged further. The Court of Cassation in France is the last resort court that only gives judgment over civil and criminal matters. Any legal matters related to the administration department do not fall in the jurisdiction of the Court of Cassation in France. The Court of Cassation in France is located in Paris. The Court of Cassation defines regulations for the lower courts in France. It also has the powers to make changes in the legislations of the legal system.
The Court of Cassation in France has six divisions: 1) First Civil Chamber, 2) Second Civil Chamber, 3) Third Civil Chamber, 4) Business and Financial Chamber, 5) Criminal Chamber and 6) Labor Chamber. The First Civil Chamber deals with legal matters related to agreements and contracts between business organizations, professionals and entrepreneurs. It also delivers judgments over issues related to intellectual property rights. The Second Civil Chamber hears cases related to family matters and minor civil issues. The Third Civil Chamber gives judgments on legal matters related to immovable properties. Business and Financial Chamber deals with issues like bankruptcy, matters related to banking and commercial transactions of corporations. The Criminal Chamber addresses issues related to crime and the Labor Chamber provides judgments over labor rights, labor arguments and labor compensation.
Each of the six Chambers has its own President Judge with three to five subordinate Judges who decide the different legal issues admitted in each of the six chambers together. There are in all one hundred and twenty five judges in the Court of Cassation. There is a concept called Full Court when the Chief Justice (also called First President) of the Court of Cassation along with all the Presidents of six chambers and senior Judges forming a board of nineteen members together decides over a complicated and serious legal matter. The Chief Justice has discretionary powers of referring a case to such Full Court. The judgment given by the Full Court considered of highest order.
The other sections of the Court of Cassation include the Administration division and the Prosecution department. The administration department is headed by the Senior Registrar who works under the guidelines set by the Chief Justice of the Court of Cassation. This administration division looks after the appointing of staff working in various sections of the Court of Cassation in France along with the communications and computing department. The Minister of the Public also has his administration office at the court .which has a Chief Registrar managing the affairs for the ministry. The Prosecution department has Chief Prosecutor, Deputy Chief Prosecutor, all of whom are assisted by 22 subordinate deputy prosecutors.
